JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-06-2022 The present writ petition has been filed seeking a direction upon the respondents to remove encroachment made by the private respondents no. 6 to 9 over Mauza-Bhabua, Ward no. 21, Anchal-Bhabua, Plot no. 207, 783, which is an Anawad Sarva Sadharan land.

The learned counsel for the petitioner has submitted that the petitioner be granted liberty to approach the Circle

Patna High Court CWJC No.3122 of 2019(3) dt.27-06-2022 2/2 Officer, Bhabua, District-Kaimur as also the Executive Officer, Nagar Parishad, Bhabua, District-Kaimur, since part of the land falls within the jurisdiction of Nagar Panchayat, for redressal of his aforesaid grievance.

Accordingly, the writ petition stands disposed off with liberty to the petitioner to approach the Circle Officer, Bhabua and the Executive Officer, Nagar Parishad, Bhabua by filing appropriate petition, within a period of two weeks from today, whereupon the said respondents no. 4 and 5 shall pass appropriate orders and take appropriate action in accordance with law, after issuing notice and hearing the effected parties. It is needless to state that in case, any encroachment is found over the public land, the same shall be removed forthwith. The entire exercise, as aforesaid, is directed to be completed, within a period of eight weeks of filing of petition by the petitioner. (Mohit Kumar Shah, J) rinkee/- U
