JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2016 Petitioner is languishing in custody since 17.10.2015 in a case registered for the offences punishable under Sections 447, 401 of the Indian Penal Code, 8/22 of N.D.P.S. Act and 137,145,147 of Railway Act.

Prosecution case is that several ladies including the petitioner were arrested from the parking of Patna Junction and from the possession of the petitioner two pieces of broken blade and A.T. Van Seductive five tablets of 1 mg each folded in a paper were recovered.

It is submitted on behalf of the petitioner that only on suspicion the accusation has been levelled. There is nothing on record to suggest that the petitioner were administering tablets to any person. A statement has been made in Para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner

Patna High Court Cr.Misc. No.4779 of 2016 (2) dt.29-01-2016 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, XI, Patna in connection with Special Case No. 36 of 2015 arising out of Patna G.R.P.S. Case No. 333 of 2015.
