Petitioner seeks bail in Belhar P.S. Case No.22 of 2009 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 17 of the CLA Act.
Counsel for the petitioner submits that Petitioner is in custody since 02.10.2018 having clean antecedents. In the written report, it is alleged that informant got information that Naxalites have injured Bhola Yadav in village. During investigation, the informant learnt that petitioner had land dispute with Bhola Yadav and for the aforesaid dispute some altercation had taken place on 17.02.2009. Thereafter, this petitioner along with other accused persons, as named, and 50-
Patna High Court Cr.Misc. No.5494 of 2019(2) dt.31-01-2019 2/2 60 unknown persons arrived at the house of Bhola Yadav and injured him after assaulting. The informant learnt name of this petitioner from the villagers as mentioned in the written report. As such, there is general and omnibus allegation against the petitioner. It is mentioned in para 3 that the petitioner has clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Banka, in connection with Belhar P.S. Case No.22 of 2009, subject to the condition that both the bailors shall be close relative of the petitioner.
