JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioners seek regular bail in connection with Mahindwara P.S. Case No. 148 of 2019, registered for offences punishable under Sections 364, 386, 387, 379 of the Indian Penal Code and Section 37 (C) of Bihar Prohibition and Excise Act.
Prosecution case is that informant boarded a Tempo, in which, four persons were sitting from before and, thereafter, the driver of the tempo took to different route, on which, the informant protested, on which, accused persons tied gamcha around his neck and took out Rs. 3500/- from his pocket and fled away. Later on petitioner and other accused persons were
Patna High Court CR. MISC. No.2413 of 2020(3) dt.25-02-2020 2/2 arrested on drunken condition.
It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and there is no recovery of amount from their possession. Further submission is that they have no criminal antecedent and they have been in custody for four months.

Having heard both sides, in view of the above , let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Mahindwara P.S. Case No. 148 of 2019, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
