The petitioner is apprehending his arrest in connection with Darauli P.S.Case No.258 of 2018 , registered for offences punishable under Sections 147, 148, 149, 302, 338 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per FIR is on Saral Pandey and Sanoj Pandey fired on the deceased causing his death. The petitioner happens to be wife of Sanoj Pandey of brick-batting from the roof-top, due to which the deceased died.
Submission of the learned counsel for the petitioner is that the FIR itself shows that there is allegation of firing against Saral Pandey and Sanoj Pandey and the petitioner has falsely been implicated in this case and there is allegation against the petitioner and other accused persons of brick-batting.
Patna High Court CR. MISC. No.6157 of 2019(3) dt.29-03-2019 2/2 1 Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail. . Having heard both sides and in view of the fact that the main allegation is against Saral Pandey and Sanoj Pandey and the petitioner happens to a lady, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM III, Siwan, in connection with Darauli P.S.Case No.258 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
