The petitioners seek bail in a case registered under Section 302/34 of Indian Penal Code.

The informant Ram Vinesh Singh lodged Udwant Nagar P.S. Case no. 158/12 under Section 302 and other Sections of IPC for killing of brother of RamVinay Singh and uncle Ramadhar Singh. The police after investigation submitted a final report. The informant filed Protest Petition and the case proceeded. The informant did not make any allegation in the FIR against the petitioners. Even suspicion was not raised against the

Patna High Court Cr.Misc. No.9383 of 2015 (2) dt.13-03-2015 2/2 petitioners but after two months of the occurrence, the informant filed protest petition and suspected the hands of the petitioners in killing of his brother and uncle. The Petitioners were granted anticipatory bail by this Court but the informant/complainant moved before Hon'ble Supreme Court in Cri. Appeal No 2617/2014. The anticipatory bail petition, granted to the petitioners, was cancelled with a direction to surrender in the Court and thereafter, the petitioners surrendered in the court below and prayed for bail. It appears that except suspicion, there appears to be no tangible evidence to show the involvement of the petitioners. Considering the facts aforesaid the petitioners above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned 4th Additional Sessions Judge, Ara, Bhojpur in connection with S. Tr. No. 263/14 (arising out of Protest Complaint No. 260©/2013).
