JUSTICE SUDHIR SINGH ORAL ORDER 10-06-2015 The petitioners are languishing in jail since 28.1.2015 in connection with Saur Bazar P.S. Case No.271 of 2014 for the offences instituted under Sections 324,323,341,447/34 of the Indian Penal Code.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that on 13.6.2014 one Kundan Yadav gave his fardbayan before the S.H.O., Saur Bazar Police Station alleging that on the same day he along with other family members was sitting at his house, all the named accused persons came there and co-accused Sofin Yadav assaulted him by Farsa and co-accused Baijnath Yadav assaulted the informant's mother by Dabiya on her head due to which she became inured. It

Patna High Court Cr.Misc. No.16156 of 2015 (2) dt.10-06-2015 is further alleged that other accused persons including the petitioners assaulted by Lathi and Rod to the other family members on account of which they got injuries. It has been submitted on behalf of the petitioners that the main allegation of assault on the deceased is against one Baijnath Yadav. So far as the petitioners are concerned, no specific injury has been attributed against them. Merely omnibus and general allegations have been made against the petitioners. It has further been submitted that the petitioners have got no criminal antecedent.

On behalf of the State, it has been submitted that the petitioners are named in the first information report. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saur Bazar P.S. Case No. 271 of 2014.
