JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught with stolen motorcycle by public and subsequently, informant reached there and took the petitioner in his custody and seized the motorcycle, but submission on behalf of the petitioner is that the motorcycle in question has not been seized from conscious possession of the petitioner and moreover, petitioner does not have any criminal antecedent. It is further pointed out by him that up-till-now, no one has come forward to claim his ownership in respect of the seized motorcycle.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named
Patna High Court Cr.Misc. No.3533 of 2016 (2) dt.04-02-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No.390 of 2015.
