The present criminal writ petition is being preferred for registering an FIR for the occurrence dated 10.11.2017. Learned AC to AG-3 submitted that admittedly, the occurrence arises out of land dispute, which is pending between the parties and as far prayer of petitioner is concerned for the same, efficacious and alternate remedies is available under the law, as petitioner may approach the Court of Judicial Magistrate u/s 156(3) of the Cr.P.C.

Patna High Court CR. WJC No.2013 of 2018(2) dt.02-01-2023 2/2 In view of the fact and circumstances, as alternate and efficacious remedies are available to the petitioner under Section 156(3) of the Cr.P.C., the present writ petition stands dismissed, however with aforesaid liberty.
