JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 11.11.2014 in a case registered for the offences punishable under Sections 376/511 of the I.P.C.

It is alleged that petitioner entered into the house of the informant and attempted to establish forceful physical relationship. The petitioner was caught on the spot but while taking to the police station he escaped. It is submitted by learned counsel for the petitioner that petitioner is neighbour of the informant and due to some dispute with regard to flow of drain water the accusation has been levelled and for the occurrence of 02.11.2014 at 11:00 P.M the First Information Report was registered on 03.11.2014 at 3:30 P.M. Moreover no medical examination of the informant was done.

A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.10682 of 2015 (2) dt.23-03-2015 2/2 petition that petitioner has no criminal antecedent and the investigation has already concluded.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil(Singhaul) P.S. Case No. 398 of 2014.
