JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-10-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner, but none appeared on behalf of the informant despite repeated calls. The petitioner apprehends his arrest in connection with Jehanabad Mahila P.S. Case No. 60 of 2019, registered for punishable under Sections 341, 323, 504, 506, 379, 498(A) 494/34 of the Indian Penal Code.
As per allegation, the marriage of the informant, Amrita Kumari was solemnized with the petitioner in the year 2011. The accused persons subjected her to cruelty for non-fulfillment of demand of dowry.
The learned counsel for the petitioner has submitted that the matter was referred to the Mediation Centre, but the informant
Patna High Court CR. MISC. No.1524 of 2020(9) dt.11-10-2022 2/2 did not appear before the Mediation Centre. The reason for nonappearance is that she has solemnized her second marriage. A supplementary affidavit has been filed by the learned counsel for the petitioner mentioning that the informant has solemnized her second marriage.
Despite repeated calls none appeared on behalf of the informant. On earlier occasion also neither the informant nor her learned counsel appeared.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad Mahila P.S. Case No. 60 of 2019 subject to condition as laid down under section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
