JUSTICE AMARESH KUMAR LAL ORAL ORDER 19-03-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks provisional bail for two months in Special Case No.64/2014 arising out of Fatuha P.S. Case No.322/2014 for the offence punishable under Sections 20 and 22 of N.D.P.S. Act and Sections 414/34 of the Indian Penal Code. It is submitted that the wife of the petitioner is suffering from cancer and for the treatment of his wife, two times earlier, the petitioner was granted provisional bail by the learned Special Judge and now the doctor has advised to appear before the Board of Doctors on 27.03.2015. Earlier, the petitioner has not misused the privilege of provisional bail.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.10599 of 2015 (2) dt.19-03-2015 2/2 let the above-named petitioner be released on provisional bail for a period of two months on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VI, Patna in Special Case No.64/2014 arising out of Fatuha P.S. Case No.322/2014. The petitioner will surrender on 19.05.2015.
This petition stands disposed of.
