JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 21.11.2014 in a case registered for the offences punishable under Sections 341,323,447,379,477 and 307/34 of the Indian Penal Code. Subsequently, section 302 IPC was added. It is alleged that accused persons including the petitioner came to the field of the informant and assaulted the informant and others. Due to assault Md. Firoj became senseless and was referred to PMCH where he succumbed to the injury. It is submitted by the learned counsel for the petitioner that specific accusation of assault to the victim is against Md. Anwar, Md. Afsar and Md. Rinka with iron road which proved fatal. It is further submitted that similarly situated accused Md.

Patna High Court Cr.Misc. No.6500 of 2015 (2) dt.19-02-2015 2/2 Islam, Md. Khursid, Md. Chunna and md. Mikael alias Nikel alias Chhuna have been granted bail vide Cr. Misc. 18255 of 2014 and co accused Md. Naim has been granted bail vide Cr. Misc. No. 23358 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa P.S. Case No. 582 of 2013.
