ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 5.6.2015 in connection with Bhagwanpur P.S. Case No. 208 of 2014, registered for offences punishable under Sections 302, 201/34 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is not named in the FIR subsequently his name has come in connection with present case on account of the confessional statement made before the police by one co-accused namely Shaligram Paswan. It is further submitted that save and except the said confession, there is no further material on record against the petitioner. Considering the period of custody and that

No.3778 of 2016 (2) dt.09-02-2016 2/2 the petitioner above named came to be implicated in the confessional statement by a co-accused before the police which has no evidentiary value, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction Additional District and Sessions Judge III, Begusarai, in connection with Bhagwanpur P.S. Case No. 208 of 2014.
