The petitioner seeks bail in connection with Tankuppa P.S. Case No. 24/2021 lodged under Sections 147, 148, 149, 341, 342, 188, 323, 324, 326, 302 of the Indian Penal Code 1860.

There is allegation of assault of killing by lathi-danda and then to throw the body of deceased in a ditch by five named and 50-60 unknown persons.

The learned counsel for the petitioner submits that there is no specific allegation against any one, all allegations are general and omnibus in nature. He further submits that there is no eye witnesses and out of five named accused persons, four were granted bail by different co-ordinate Benches of this court

Patna High Court CR. MISC. No.2947 of 2022(2) dt.09-06-2022 2/2 vide order dated 08.03.2022, 10.03.2022, 13.05.2022 passed in Cr. Misc. no. 40871/2021, Cr. Misc. no. 53106/2021, Cr. Misc. No. 66130/2021 and Cr. Misc. no. 64781/2021 respectively. He also submits that petitioner is in custody since 21.02.2021 and he has got no criminal antecedent.

Learned APP for the State has opposed the prayer for bail.

Considering the fact that the allegation is general and omnibus against 55 persons and co-ordinate Benches have already granted bail to four persons and also considering the period of custody that the custody since 21.02.2021 and charge sheet has already been filed, let the petitioner, above named be granted bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-XII, Gaya, in connection with Tankuppa P.S. Case No.24/2021.
