1. Heard learned Senior counsel for the petitioner Mr. Ramakant Sharma and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Sono P.S. Case No.334/2023 dated 21.09.2023 registered for the offence punishable under Sections 147, 149, 341, 332, 323, 337, 338, 307, 353, 504 and 506 of the Indian Penal Code.
3. Learned Senior counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant who is S.H.O. of Charkapathar P.S. has instituted the instant F.I.R. alleging therein that the police force had gone to apprehend an accused of Charkapathar P.S. Case No.304/2023 when the accused on seeing the police forced started fleeing but he was chased and caught when his family members and
Patna High Court CR. MISC. No.4692 of 2024(2) dt.19-02-2024 2/3 villagers gathered and surrounded the police and thereafter assaulted damaging the police vehicles. It is next alleged that several personnel received injury. It is further alleged that one person Gopal Yadav was arrested who along with the chowkidar disclosed the name of other persons involved in the occurrence. The learned senior counsel next submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that the allegation of assault is general and omnibus in nature. It is also submitted that though it is alleged that police personnel were assaulted but then there is no injury report on record. It is also submitted that the allegation of causing assault is also not specific. At the cost of repetition, it is submitted that the petitioner is a person with clean antecedent.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Jamui in
