JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased, who died within 2 years of her marriage. There is accusation that the deceased was subjected to cruelty and harassment due to non-fulfillment of illegal dowry demand.

Paragraph-62 of the case diary, goes to show that several injuries were found on the person of the deceased and her cause of death was shown as asphyxia due to strangulation and, therefore, taking note of the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Phulwarisharif (Janipur) P.S. Case No. 249 of 2015 pending in the court of Sri Jyoti Prakash, learned Judicial Magistrate-Ist Class, Patna stands rejected. (Hemant Kumar Srivastava, J) A.K.V./- U T
