Learned counsel for the petitioner submits that issue being raised in the present writ application has already been settled by a Division Bench judgment of this Court in CWJC No.13888 of 2016 (Dr. Rajesh Kumar Sinha v. the Union of India), disposed of on 16.12.2016.
