JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased who died within three months of her marriage. There is accusation that petitioner and his other family members were demanding motorcycle in dowry and when the aforesaid demand was not fulfilled, they started torturing the deceased, who subsequently, died in mysterious circumstance.
Contention on behalf of the petitioner is that in course of investigation, it came to light that mother in law of the deceased forbade her not to go outside on natural call and that was the reason the deceased committed suicide which is evident from
Patna High Court Cr.Misc. No.3270 of 2016 (3) dt.25-02-2016 2/2 perusal of post mortem report itself.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Rahui (Bhagan Bigha) P.S. Case No. 250 of 2014 pending in the court of Chief Judicial Magistrate, Nalanda at Biharsharif stands rejected.
