The petitioner seeks regular bail in connection with Arwal P.S. Case No. 111 of 2019 for the offences punishable under Sections 457/380 of the Indian Penal Code. The allegation is regarding unknown miscreants having committed theft in the house of the informant and are stated to have looted various articles including jewelry etc. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 13.11.2019. Lastly, it is submitted that the petitioner has been implicated in the present case upon confessional statement of the co-accused

Patna High Court CR. MISC. No.1227 of 2020(2) dt.17-01-2020 2/2 person, namely, Sangita Devi, who is said to have disclosed that the mobile, which she was carrying, was purchased from the petitioner herein.

Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that no incriminating article or stolen articles have been recovered from the possession of the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S.
