The petitioner seeks bail in Mahishi P.S. Case No. 64 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

Chandan Paswan named the petitioner along with other accused persons and alleged that while there was quarreling Indal Paswan, Bablu Paswan the petitioner and Hira Paswan came with firearms and on the order of Kalo Paswan and Ramakant Paswan, Indal Paswan fired which hit Kanchan Devi in her lower part of abdomen.

Learned counsel for the petitioner submits that there is no allegation of firing against the petitioner. Hira Paswan whose case

Patna High Court Cr.Misc. No.14633 of 2015 (2) dt.24-04-2015 2/2 stands on the same footing has already been enlarged on bail vide order passed in Cr. Misc. No. 5669 of 2015.

Considering the facts aforesaid and the fact that the petitioner is not alleged to have fired and case of the petitioner stands on the same footing as that of Hira Paswan, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No. 64 of 2014.
