JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One co-accused, Md. Mahboob was arrested by the police from the spot just after the alleged occurrence and the aforesaid co-accused, Md. Mahboob disclosed the name of petitioner and other accused persons who are said to have participated in the alleged crime.

Learned counsel for the petitioner submits that except the aforesaid confessional statement of co-accused, Md. Mahboob, there is nothing against the petitioner. It is further contended by him that prior to institution of the present case, the petitioner was made accused in Ara Town P.S. Case No. 115 of 2015 in which he has already been granted privilege of bail.

Patna High Court Cr.Misc. No.3318 of 2016 (2) dt.03-02-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 149 of 2015.
