Petitioners seek bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
450 liters of liquor was recovered from possession of the petitioners. Petitioners have stated on oath that they have got no criminal antecedent.
Submission is that petitioner No.1-Kamal Singh is suffering from AIDS and mother of petitioner No.2-Anup Singh has died on 11.01.2020.
Considering the aforesaid facts, let the petitioners,
Patna High Court CR. MISC. No.816 of 2020(2) dt.16-01-2020 2/2 above named, be released provisionally on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.422 of 2019, subject to the condition that the both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioners shall not leave the country without permission of the Court and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
Petitioners shall attend the court regularly till framing of the charge.
The learned Trial Court shall expedite the framing of charge and thereafter confirm provisional bail of the petitioners. (Birendra Kumar, J) Nitesh/- U T
