The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 353, 332, 333 and 188 of the Indian Penal Code, Section 27 of the Arms Act and Sections 51(1) (B) of the Disaster Management Act, 2005.

There is exchange of firing between Samir Kumar and Baccha Singh. The informant who is police official gave information to the Senior Police Officer about it and ordered to stop the firing but they did not stop and started pelting stones upon police party.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He

Patna High Court CR. MISC. No.2619 of 2022(2) dt.01-08-2022 2/2 further submits that in exchange of firing, one person sustained bullet injury. He further submits that there is no specific allegation against this petitioner of committing the offence and petitioner is a public servant.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 245 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
