JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and two others were caught when they were engaged in cutting electric wire and electric wire was recovered from the place of occurrence. Moreover, petitioner is in jail custody since 20.11.2015 without any criminal antecedent. The contention on behalf of the petitioner is that the petitioner resides near the place of occurrence and, as a matter of fact, police arrested the petitioner from his house on mere suspicion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.5534 of 2016 (2) dt.15-02-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Kankarbagh P.S.Case No. 790 of 2015.
