The petitioners are languishing in custody since 17.10.2015 in a case registered for the offences punishable under Sections 447, 401 of the Indian Penal Code, 8/22 of NDPS Act and 137/145/147 of the Railway Act, 1989. Seven ladies were apprehended from the car parking of the Patna Railway Station including the five petitioners. On search being made from the petitioner no. 1 Anita Devi two

Van(1 mg) each, from the possession of petitioner no. 2 Sunita Devi three pieces of broken blade and five tablets of A.T. Van (1 mg) each, from the possession of petitioner no. 3 Savitri Devi two pieces of broken blade and six tablets of A.T. Van (2 mg) each, from the possession of petitioner no. 4 Vibha Devit three pieces of broken blade and five tablets of A.T. Van (2 mg) each and from the possession of petitioner no. 5 Rekha Devi one piece of broken blade and six tablets of A.T. Van (1 mg) each were recovered. Subsequently, three other ladies were also apprehended, namely, Pakko Devi, Anjali Devi and Manisha Devi and from them also similar recoveries were made.

It is submitted by learned counsel for the petitioners that there is no accusation that the petitioners either administered or in process of administering tablets to railway passengers or any person and only on suspicion the accusation has been levelled. The investigation has already concluded. Considering the fact that some of the petitioners were earlier made accused in the case of Immoral Traffic Act but not in a case of similar nature and the investigation has already concluded, let the above named petitioners, be released on bail on furnishing bail bonds of
