====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 06-02-2017 Heard the learned counsel for the petitioner. Perused the impugned order dated 15.10.2016 passed by Principal Judge, Family Court, Vaishali at Hajipur in Maintenance Case No.32 of 2015 whereby the learned court below directed the petitioner to pay interim maintenance of Rs.4,000/- per month. The learned counsel for the petitioner submitted that now the wife has come to the petitioner and both are residing together.

If this is the fact, as submitted by the learned counsel for the petitioner, the petitioner is at liberty to approach the court below for proper modification of the order or recall of the order. So far this civil miscellaneous application is concerned, it has now become infructuous.

Patna High Court C.Misc. No.215 of 2017 (2) dt.06-02-2017 Therefore, this civil miscellaneous application is dismissed as infructuous with liberty to the petitioner to approach the court below along with his wife.
