JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner as well as learned Additional P.P. for the State.

The petitioner happens to be mother-in-law of the deceased and is languishing in jail custody since 4.8.2015 in a case registered under Sections 304B/34 of the IPC. The deceased died within one year of her marriage in other than normal circumstances but no specific overt act of illegal demand as well as torture has been leveled against the petitioner. Moreover, the husband of the deceased has already been remanded to jail custody.

Accordingly, the petitioner Ayesha Khatoon is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K.Gond, Judicial Magistrate, 1st Class, Khagaria, in connection with Beldaur P.S. No. 37/2015 corresponding to G.R. No. 442/2015.
