The petitioner has filed the instant application for grant of regular bail in connection with Bihta P.S. Case No. 443 of 2022 registered under sections 304(B) and 34 of the Indian Penal Code.

Allegation against the petitioner along with other co-accused persons is that the daughter of the informant married with Sunny Kumar, but soon after marriage, his daughter was subjected to cruelty due to non-fulfillment of demand of dowry of Rs. 5 lakhs by her in-laws family members including this petitioner. Informant further alleged that on 09.05.2022, when the whole family had gone to a

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is mother-in-law and due to which she has falsely been implicated in this case. It is further submitted that the allegation of instigating his son for demanding Rs. 5 lakhs as dowry is false. The husband of the deceased is already in judicial custody. During investigation, no independent witness has been examined by the investigating officer. Petitioner has no concern with the alleged occurrence. She has no concern with mess and business of the deceased as well as from her husband. She is languishing in judicial custody since 21.05.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bihta P.S. Case No. 443 of 2022 on
