The petitioner is languishing in custody since 29.09.2014 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Cash containing bag being carried by Sanjay, who was pillion rider of informant, was robbed after putting chilli powder in the eyes of Sanjay. The petitioner was apprehended on suspicion when he confessed his guilt.

Statement has been made in para 12 and 13 of the petition that neither there is any recovery from the petitioner nor the petitioner has been put on TIP.

No.6359 of 2015 (02) dt.19-02-2015 2/2 Considering the fact that petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur (Town) P.S. Case No. 697 of 2014. Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
