====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 27-02-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.

Petitioner along with his two sons namely Ashok Mahto and Govind Mahto and others are said to have kidnapped the minor daughter of the informant while she had gone to her school and the victim is still traceless.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case merely on suspicion as he happens to be father of Ashok Mahto and Govind Mahto. He

Patna High Court CR. MISC. No.3442 of 2019(3) dt.27-02-2019 2/2 happens to be aged person and has been apprehended from his house without any fault on his part. There is no eye witness of the occurrence. He has been languishing in custody since 27.08.2018.

On the other hand, learned APP for the State opposing the bail petition submitted that the victim is still traceless, hence the petitioner does not deserve bail. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I West, Muzaffarpur in connection with Saraiya P.S. Case No. 372 of 2018.
