Petitioner seeks bail in a case under Sections 364/34 IPC. The petitioner is not named in the F.I.R. but his name figured in the case on mere suspicion. The victim returned and made his statement under section 164 Cr.P.C. but did not name the petitioner. The Investigating Officer, did not collect any evidence to show the involvement of the petitioner in the kidnapping of the victim.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri S.C. Kumar, Judicial Magistrate, Ist Class, Jamui in connection with Chandradeep P.S.Case No.41 of 2014.
