JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 22-01-2025 At the outset, learned counsel for the petitioner would submit that the matter of the petitioner is squarely covered with the judgment passed by this Court in case of Binit Kumar & Ors. vs. The State of Bihar (C.W.J.C. No. 9921/2017). On the basis of which subsequently this Court also disposed of C.W.J.C. No. 6308/2023, therefore, in the light of the above mentioned judgments, this petition may be disposed of.

2. Learned counsel for the State submits that the petitioner may be directed to firstly make a representation before the respondent raising all the grounds which he raised in this writ petition and on submission of said, the concerned

Patna High Court CWJC No.709 of 2025(2) dt.22-01-2025 2/2 authority will decide the same within a specific period fixed by this Court.

On the basis of submission made by learned counsel for the State, this petition is disposed of and the petitioner is directed to firstly make representation before the respondent/ concerned authority raising all grounds which he raised in this writ petition within two weeks' from today and on submission of said representation the concerned authority/ respondent is directed to consider and decide the same in accordance with relevant rules and laws and further taking into consideration the judgment passed by this Court in the case of Binit Kumar & others (supra) and pass a reasoned order as early as possible probably within 45 days from the submission of the said representation.
