JUSTICE MADHURESH PRASAD ORAL ORDER 20-03-2020 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Prosecution case is in respect of offence under section 304B of the IPC.

Petitioner no.1 is brother-in-law (Dewar) and petitioner no.2 is brother-in-law (Bhaisur) of the victim girl. It is submitted by counsel for the petitioners that even as per allegation made in the FIR, petitioner no.1 is the person who has intimated the informant regarding death of the victim girl which is a clear indication of the bonafides of petitioner no.1.

Petitioners merely by virtue of their relationship, have been implicated in this case and are in custody since 03.08.2019

Patna High Court CR. MISC. No.1515 of 2020(3) dt.20-03-2020 2/2 and 06.08.2019 respectively.

Learned A.P.P. opposes the prayer for bail.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub Judge XIV-cumACJM XIII, Muzaffarpur in Aurai P.S. Case no. 96/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(2) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
