JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120B/34 of the Indian Penal Code and Section 3⁄4 of Examination Act.
The accusation against the petitioner is that one Chandra Shekhar Kumar appeared in place of petitioner in the Constable Recruitment Examination and for the aforesaid allegation, petitioner is in jail custody since 14.12.2015. Petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.10704 of 2016 (2) dt.08-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri N. Dayal, Judicial Magistrate, Bhagalpur in connection with Kotwali (Tatarpur) P.S. Case No. 675 of 2012.
