The petitioner is languishing in custody since 05.01.2015 in a case registered for the offences punishable under Sections 341, 323, 504, 308 and 379/34 of the Indian Penal Code. It is alleged against the petitioner that the petitioner assaulted on the head of the informant with Dabia when wife and son of the informant came to rescue then co-accused Samila Devi assaulted the wife of the informant by fists and legs when the petitioner and other accused persons assaulted the son of the informant with lathi, danda. The female accused persons snatched gold chain and ring from the wife of the petitioner. Though, the injury caused by the petitioner has been found to be

It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow. The petitioner is aged about 76 years and suffering from several ailments. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that there is no accusation of repeating the blow and the petitioner being aged person, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Gamaharia P.S. Case No. 37 of 2014.
