The petitioner seeks bail in Bakhri P.S. Case No.308 of 2019 registered under Section 30(a) of Bihar Excise and Prohibition Act.
The informant got secret information that the petitioner and other accused persons jointly brought a truck loaded with liquor and after unloading the same they brought a pick up van to supply the liquor, on such, a raid was conducted and huge quantity of liquor was recovered from the maize field. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Sanjit Kumar Mahto @ Sanjit Mahto has been granted regular bail but it appears that petitioner has got criminal antecedent and he is accused in six other criminal cases
Patna High Court CR. MISC. No.1160 of 2020(5) dt.03-07-2020 2/2 including the cases registered under Sections 302, 201 and other Sections of the Indian Penal Code, Section 27 of the Arms Act and different Sections of the Excise Act.
Considering the fact that petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Saurabh/- U T
