The petitioner apprehends his arrest in Kadwa P.S. case No. 89 of 2016 under Section 354, 354A, 354B, 379, 386, 506 and other Sections of the Indian Penal Code. The informant alleged that an accident took place in which a motorcyclist got injured and he was being taken to hospital. 500-700 persons assembled near the house of informant and they were saying that husband of informant assaulted the deceased and killed him. The informant made allegation that the mob pelted stones, ransacked the house of informant and took away different articles from her house.

The learned counsel for the petitioner submits that one Naresh Kewat was brutally assaulted by the husband of informant for which another case is filed. The villagers assembled

Patna High Court Cr.Misc. No.1270 of 2017 (2) dt.16-01-2017 2/2 near the house of informant for protest but the informant in order to save her husband lodged this case. The petitioner is, of course, named in the FIR but no specific allegation is made. Seven other accused persons, namely, Ashok Kewat, Basudeo Kewat and others have already been granted anticipatory bail vide order passed in Cr. Misc. No. 42080 of 2016. The case of petitioner stands on same footing.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Katihar in Kadwa P.S. Case No. 89 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
