Petitioner apprehends arrest in a case registered for the offence punishable under sections 447, 341, 427, 323, 325, 147, 149, 354, 379, 504 and 506 of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons including this petitioner armed with lathi, danda and rod assaulted the informant in which he sustained injury. It is further alleged that when his family members came to save him, they were also assaulted by them. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to pending land dispute between the parties. There is a case and counter case. Doctor has found simple injury. Petitioner claims clean

Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rosera, Samastipur having G.R. No. 465 of 2022 in connection with Bithan P.S. case no 65 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
