One Sunny is named in the first information report but in course of investigation, petitioner was made accused. Admittedly, nothing has been recovered from the conscious possession of the petitioner nor he has been put on TI Parade. Although learned court below has referred some paragraphs of the case diary to show involvement of the petitioner in the alleged crime but considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Nathnagar P.S.
