The petitioner is accused in connection with Vidyapati Nagar (Ghato) P.S. Case No. 30 of 2016 registered under Section 302/34 of the Indian Penal Code pending in the Court of Judicial Magistrate, 1st Class, Dalsingsarai, District - Samastipur.

Submission of learned counsel for the petitioner is that earlier on merit prayer of the petitioner for bail was rejected twice by this Court on 13.09.2017 and 07.03.2018 passed in Cr. Misc. No. 36918 of 2017 and Cr. Misc. No. 12593 of 2018 respectively. Further submission is that petitioner is in custody since 16.03.2017, having no criminal antecedent.

Patna High Court CR. MISC. No.3122 of 2019(4) dt.06-03-2019 2/2 Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer of the petitioner by contending that earlier twice prayer of the petitioner for bail was rejected. There is no fresh ground on behalf of the petitioner. Having considered the facts and circumstances of the case and the submissions advanced on behalf of both the parties, I am not inclined to allow the prayer of the petitioner. Accordingly, prayer of the petitioner for bail is rejected. However, Trial Court is directed to conduct the trial on day-to-day basis and conclude the same within a period of six months.
