JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Katihar (Town) P.S. Case No.284/16 registered under Sections 399, 402 of the Indian Penal Code and Sections 25 (1-B) (a)/26/35 of the Arms Act.

The accusation is that on receiving secret information of committing heinous crime by some miscreants near K.B.C. Office, the police reached there where six persons were seen on three motorcycles. On seeing the police party all the miscreants started to flee away but on chase one of the miscreants was apprehended who disclosed his name as Aniket Kumar Sah and on search two live cartridges were recovered from his pocket. On query he disclosed the name of his three associates as Md.Rinku @ Tarikh, Md. Iklakh, Suraj Kumar Singh and also disclosed the name of this petitioner as head of the gang supervising the whole episode. Learned counsel for the petitioner submits that the petitioner has falsely been implicate by the police with an ulterior motive.

Having considered the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner is rejected.
