JUSTICE SUDHIR SINGH ORAL ORDER 11-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Pipra P.S. Case No. 184 of 2014 for the offences instituted under sections 302, 201 of the Indian Penal Code. The prosecution story, in brief, is that the informant Bijay Kumar lodged the F.I.R. alleging therein that his father Rajendra Prasad Yadav had gone for bringing building material on a tractor. At about 8.30 P.M. in the night the tractor returned but his father did not return. On enquiry from the driver, it was informed that his father will come later on by motor cycle. When his father did not return then the informant went in search of him and saw some crowd near Gamharpur where a dead body
Patna High Court Cr.Misc. No.15900 of 2015 (2) dt.11-06-2015 was lying which on verification was found to be of his father. It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. and subsequently in course of investigation, the name of the petitioner has appeared. It is further submitted that a suspicion has been raised against the petitioner only on the basis that the deceased and the petitioner had a common liking for one Buchni Devi and for the said reason the petitioner is being suspected to have committed the alleged offence. Except that there is no direct or indirect evidence against the petitioner. The petitioner has no criminal antecedent and is in custody since 23.11.2014.
On behalf of the State it has been submitted that in course of investigation the name of the petitioner has appeared. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Supaul in connection with Sessions Trial No. 36 of 2015 arising out of Pipra P. S. Case No. 184 of 2014.
