JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to prosecution case, marriage of deceased was solemnized with the petitioner about 5 years ago but subsequently, she was subjected to cruelty and was done to death for nonfulfillment of dowry. Contention on behalf of the petitioner is that according to prosecution case itself, the deceased died on 28-05-2015 but the complaint was filed on 02-06-2015. It is further contended by him that moreover, after institution of the present case, the informant filed a petition before the Judicial Magistrate, Kaimur mentioning this fact that the marriage of deceased was solemnized with
Patna High Court Cr.Misc. No.4992 of 2016 (2) dt.11-02-2016 2/2 petitioner on 12-08-2007 and there was no demand of dowry nor the deceased was subjected to cruelty and furthermore, the informant disclosed in the aforesaid petition that he lodged the present case at the instance of villagers.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Karamchat P.S. Case No. 28 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua.
