The petitioner is in custody since 12.10.2015 in connection with a case registered for the offences punishable under Sections 25(1-B)A,26, 35 of the Arms Act.
Learned counsel for the petitioner submits that though there is allegation of recovery of arms from the person of the petitioner yet, in fact, there was no such recovery and seizure-list itself indicate that there was no independent witness to support the prosecution case. He submits that since he has opposed the collection of illegal money by the Police personal from the sand loaded trucks, the petitioner has been roped into the present case. Considering the aforementioned facts and circumstances
Patna High Court Cr.Misc. No.3756 of 2016 (2) dt.10-02-2016 P2/2 and that the petitioner has no criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S.
