JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, earlier the prayer for bail of the petitioner was rejected but he is in jail custody since 19.09.2012 in a case registered under Section 395 of the I.P.C.

The report of the learned Trial Court reflects that up till now not a single prosecution witness could be examined particularly in the circumstances when charge was framed against the petitioner on 03.03.2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the period of detention of the petitioner in custody, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-

Patna High Court Cr.Misc.
