ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 21.08.2015 in connection with a case registered for the offences punishable under Sections 147 and 304 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is motivated on account of previous enmity and general and omnibus allegation have been made against several persons alleging that they had used Gamcha to strangulate and assaulted the informant's husband with fist and hands.

However, considering the nature of allegation made and also the fact that no treatment was given to the deceased just after the occurrence and also because this petitioner has no criminal

Case No. 417 of 2015.
