JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, this petitioner, son of Sahdeo Paswan, along with two other unidentified miscreants assaulted the informant and snatched his motor cycle. It is submitted that as per FIR the identified accused is son of Sahdeo Paswan but without going into proper verification this petitioner has been made accused in this case. It is submitted that Sahdeo Paswan has six sons and petitioner is one of them. No incriminating article has been recovered from the possession of this petitioner and till date petitioner has not been put on Test Identification Parade. Petitioner is in custody since

Patna High Court CR. MISC. No.5017 of 2022(2) dt.05-04-2022 2/2 14.06.2020 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Jamui in connection with Sikandra PS case No.146/2019.
