This is third attempt on behalf of the petitioner, whose prayer was earlier refused on 17.07.2012 in Cr. Misc. No. 9035 of 2012 and consequently on 23.10.2013 in Criminal Miscellaneous No.19723 of 2013 in connection with Brahmpura P.S. Case No.168 of 2011, pending before the Chief Judicial Magistrate, Muzaffarpur.

Perused the report of the trial court received through letter no. 62 dated 12.02.2015 indicating examination of six witnesses out of 11 cited with the chargesheet but the progress appears slow. Further petitioner, as submitted, carries no criminal antecedent.

If it is so, on the undertaking to be remain physically present on each and every date, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No.107 of 2012 arising out of Brahmpura P.S. Case No.168 of 2011, subject to condition to remain physically present before the court below on each and
