Mr.Dashrath Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Sessions Trial No. 357 of 2018 arising out of Pawana P.S. Case No. 26 of 2018 for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

The allegation is regarding the deceased having been killed by her husband along with the petitioner herein. Thereafter, it is alleged that the dead body was made to disappear.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the deceased lady is said to have died on account of illness and the dead body was cremated after consent

It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 29.08.2018. Lastly, it is submitted that the husband of the deceased has already been granted bail by this Court by an order dated 06.10.2018 passed in Cr. Misc. No. 56889 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Bhojpur at Ara in connection with Sessions Trial No. 357 of 2018 (arising out of Pawana P.S. Case No. 26 of 2018).
